Recall in the hearing, the judge said “Then I'm going to make a finding. This Court has jurisdiction. I'm going to make a finding that the children are in need of protection in this case. I find that continuation in the home is contrary to the welfare of the children due to Ms. Vaughn having the children in the vehicle while she was legally intoxicated, placing the children in impending danger and that Ms. Vaughn left the children in the care of their father who had recently been released from a three year prison term for physically abusing the daughter Sarah. The children were placed in the department’s protective custody on March 15 and it is the recommendation that they remain in protective custody, and that the department has found a family placement and the children are placed together for the recommendations of the statutes. The department has made reasonable efforts in this case to preserve the family by contacting family members and placing the children with family together. “
